1. Overview
This chapter is not a legal treatise on the relationship between shipmaster and pilot; it describes the day-to-day working arrangement between two professionals. For the legal side, the author points the reader to Law of Tug, Tow, and Pilotage, the principal reference behind the discussion.
At first glance the relationship looks poorly defined. The areas of responsibility seem nebulous and even conflicting: the master appears answerable for much of the work done by a pilot whom the master neither selects nor — under compulsory pilotage — is free to refuse. Case law only adds fog, leaving the mariner to "navigate under Rule Nineteen."
In practice it works well. Master and pilot are experienced professional seamen completing a passage together, guided by a relationship shaped through custom and practice over centuries; thousands of ships move each year without incident. The arrangement looks complicated only when a casualty forces an informal, well-understood working relationship into the unfamiliar language of the courtroom.
2. The Pilot Aboard Ship
The pilot boards to take charge of the navigation of the ship from the pilot station to her destination, or to an intermediate point where multiple pilots are used. The pilot moves the ship using local knowledge and a degree of shiphandling skill the seagoing master is generally not expected to possess. The landman's picture of a quaint old pilot mumbling advice at the master's side while the ship proceeds under the master's direction is patently incorrect: the pilot must also command the mariner's own skills — the rules of the road, navigation, and the use of all navigation equipment.
2.1 What Local Knowledge Includes
"Local knowledge" is broad enough to encompass nearly the whole of the pilot's expertise, but at a minimum it covers six areas:

2.2 Voluntary versus Compulsory Pilots
A clear distinction must be drawn between the two. A voluntary pilot is engaged for the convenience of the vessel where no statute requires one — for example, a North Sea pilot taking a ship between the Rotterdam and Bremerhaven sea buoys. The owner, through the master, has great control over such a pilot: the pilot need not be hired at all, and the services may be rejected during the passage. The voluntary pilot stands in much the same position as the ship's own mates, so the master may freely advise or relieve.
A compulsory pilot, by contrast, is required by law while the ship navigates certain specified areas; fines or imprisonment are the hallmark of compulsory pilotage statutes. If a ship may lawfully refuse a pilot by paying a portion of the fee, the pilotage is not compulsory. The compulsory pilot is generally neither an employee nor a crew member, is defined by custom, practice, and statute rather than contract, yet is ultimately subordinate to the master — though less so than popularly believed.

2.3 The Panama Canal Exception
The traditional relationship is distorted at the Panama Canal, where the Authority accepts greater liability in exchange for greater control over navigation in that strategic waterway. Inside the locks the Authority is liable for injury to vessel, cargo, crew, or passengers arising from a passage under the control of its employees — unless it shows the injury came from a negligent act of the vessel. Outside the locks the Authority is liable when injuries are proximately caused by a Canal Commission employee's negligence, provided that, for a ship required to carry a Canal pilot, the navigation was under that pilot's control at the time. Masters should know how the customary relationship is reshaped here.
3. The Master's Responsibilities in Pilotage Waters
The master retains overall responsibility for the vessel and her operation: a competent watch working efficiently, a proper lookout, and compliance with all regulations and statutes, including the rules of the road (COLREGS). The master's authority is never completely in abeyance, even while a pilot has immediate charge of navigation. The master is also responsible for his own professional competence — enough knowledge and experience to judge the pilot's performance, recognize significant pilot error, and know the local waters' published dangers.
3.1 The Duty to Advise or Relieve
The master has a duty to advise or relieve a pilot in four cases:

The master may advise or relieve at his discretion, but there is a real burden to justify relieving the pilot should a casualty follow, so the act must not be arbitrary. The master must not relieve merely because he feels he could do a better or quicker job; the pilot is relieved only when the master judges, on professional experience and training, that vessel, crew, or cargo is being placed in real and imminent danger. Conversely, the master is negligent if he fails to act when required. The proper sequence is graduated: first object to the action, then recommend an alternative, and only when the pilot refuses the recommendation does the master relieve — in time to still avoid the accident.
3.2 The Problem of Timing
Deciding when to become involved is harder than deciding whether involvement is necessary. There is a natural reluctance to act because of the consequences after a casualty, yet timing is the most critical question. Relief usually comes too late — after the situation has deteriorated so far that even the finest shiphandler could not recover it, so the master's efforts only complicate matters. A ship need not be in extremis before the pilot is relieved; it is enough that the master foresees danger if the present course continues.
4. "Release from Liability" Forms
A master is occasionally handed a form to sign that purports to release the pilot from liability, arising from local practice or special circumstances such as a tugboat strike. Their validity in any given case is questionable and depends on local laws the master cannot reasonably be expected to know.
Under pressure not to delay the vessel and unable to consult anyone, the master may elect to sign — but should note over the signature that the release is "Signed under protest so that the vessel may proceed," make an entry to that effect in the ship's log, and forward a copy to the owners for future guidance. In any case the form has no immediate practical effect: the master holds ultimate responsibility for the ship regardless, and the document in no way alters his conduct during the work at hand.
5. Some Practical Considerations
The real world must be kept in view. In practice a pilot will not refuse to work more safely, to slow down, or to take an additional tug when the master asks, so a conflict over relative authority almost never arises. This duality of interest benefits everyone: as long as one of the two wants to work safely the ship is handled properly, and when both act professionally the concern of one amplifies the concern of the other.
Very few casualties occur in pilot waters without some degree of acquiescence by the master. In many cases, had the master merely suggested that the pilot reduce speed in fog or clarify a meeting arrangement with an approaching vessel, no accident would have followed. The master must not wait until the situation is hopeless: the time to get involved — at least to question the pilot's intentions — is the first moment there is any doubt about the correctness of the pilot's actions.
5.1 Options in an Irreconcilable Disagreement
When an irreconcilable disagreement over a course of action does arise, each party has defined options.

The master intervenes only when the pilot's work endangers ship, cargo, crew, or assisting tugs — never because a job could be done more expeditiously. Such differences must not be exaggerated: they almost never occur, precisely because of the professional context in which objections are made.
5.2 Team, Not Committee
The growth of the "team concept" of shipboard organization has complicated matters by casting the pilot as one more team member, as if hired as crew for the passage — clearly untrue of a compulsory pilot providing a one-time service. The well-organized crew has always worked as a team under the master, but the valid team is organized vertically: mate, helmsman, watch engineer, and others perform tasks assigned by the pilot through the master — machinery operation, record keeping, position fixing, radar plotting — all to support whoever has the conn.
6. Bridge Resource Management for Shiphandlers
Proper bridge organization is commonly called Bridge Resource Management (BRM). It is designed to reduce errors and omissions through a system of checks and the delegation of duties; training in BRM is required by regulation, and its benefits are steadily recognized across the industry. BRM evolved from Cockpit Resource Management, developed by the airline industry after studies showed human error contributed to most accidents. This is not a text on BRM — it is discussed only as far as it affects shiphandling.
6.1 Key BRM Terms
Several BRM terms are central to good shiphandling practice:

The bridge team shares the workload, obtains and communicates relevant information early, and monitors progress by cross-checking the decisions and actions of all members — always within the master/pilot relationship. A committee makes joint decisions and enjoys some equality of decision-making responsibility; a ship's bridge instead requires discipline, a defined chain of command, and a clear understanding of who holds the conn.
6.2 BRM Does Not Alter the Master/Pilot Relationship
Proper BRM formalizes the roles of the participants, but it does not alter the customary roles and relationship between master and pilot for the waters in which the vessel operates — and the same holds when the pilot has gone ashore and a deck officer handles shiphandling in restricted waters. The relationship is not changed by law or good seamanship regardless of what a ship's operating manual may state, because ships operate in a larger world where custom, practice, and precedent prevail. The pilot comes aboard to take the conn, lead the bridge team as he finds it, and assume responsibility, subject only to the master's obligation to relieve in the specific circumstances above. On a well-run bridge, each member acts as a filter, removing extraneous information and duties so the conning officer can focus on safe movement of the vessel.
6.3 Watch Conditions and the Bridge Team
A bridge team consists of anyone needed for safe navigation — master, deck officers, unlicensed crew, and the pilot — and must be large enough to cover the three general areas of bridge duty: collision avoidance (detecting and avoiding other vessels and objects), navigation (keeping clear of shoal water, close to track, near to schedule), and administration (routine watch duties such as communications, log keeping, and supervising watch personnel). The size of that team varies with the watch condition, dictated by visibility, waterway, and traffic.

The condition is set by a combination of factors: a ship in clear visibility and light traffic but in pilotage waters is watch condition 4. As a situation becomes more information-intensive or less error-tolerant, more people are needed. The division of duties resembles triage — personnel are added so the person conning can focus on the task — with deliberate overlap so members cross-check each other. Duties are not static or exclusive to one officer; they are divided by the expertise of the team, so the pilot may handle most radio traffic yet delegate less essential calls to the master or watch officer.

6.4 The Master/Pilot Exchange and Bridge Meetings
Watch condition 4 begins once the pilot comes aboard, and the conn is exchanged after completing the Master/Pilot Exchange (introduced in chapter 1). This exchange familiarizes the crew with the pilot's role and prepares the team for the passage, helping form the shared mental model that effective BRM requires. Because conditions aboard are dynamic, the master is responsible for training the team to adapt, and should schedule meetings at several stages of a voyage:

Passage planning and the bridge team are not new ideas; they have been practiced for generations aboard well-run ships. BRM training simply formalizes the bridge organization that good captains once put in place inconsistently, by individual leadership skill alone. Professional shiphandlers should add a dedicated BRM text to their library and work within that organization to move ships safely in pilot waters.
7. The Cost of Responsibility
Authority, responsibility, and liability are inseparable, so fault is inevitably assigned after any casualty according to perceived responsibility. The day when pilots and mariners paid with their lives is long past; present-day penalties are mainly lost income or fines. These penalties may satisfy a perceived need to enforce standards and assign blame, but they can be counterproductive: their existence can cause a master to delay corrective action when he is weighing whether to relieve a pilot. Casualties are usually the result of errors in judgment rather than gross negligence or intentional misconduct, and the penalties are assigned after the fact by a third party with only a limited appreciation of the marine profession.
It is essential that neither master nor pilot become too bound up in legality and liability while working. These considerations are significant, but there is an overriding professional and moral obligation to use all their talents to move ships safely and expeditiously; their actions should be instinctive and in the best interests of the ship. When a master or pilot hesitates to act as he sees proper out of concern for some later review or liability, it is time to seek another career.
